FACILITY RENTAL POLICIES

AGE REQUIREMENT ACKNOWLEDGEMENT

Please be aware that the individual or group representative reserving and renting any KST facility must be at least 21 years of age. By initialing below, you confirm that you meet this age requirement and acknowledge that this requirement is strictly enforced.

PAYMENT

Rental(s) will be invoiced upon approval and sent to the applicant's listed contact. After the invoice is sent, the booking dates and times will be held for 48 hours. If the invoice is not paid within this period, the invoice will be canceled, and the dates/times will be released for others to book. To secure the booking, a non-refundable deposit of 50% of the total rental amount is required. Rentals within 30 days must be paid in full at the time of booking. Once the invoice is paid and the rental agreement is signed by both parties, it will serve as a binding contract. A final invoice will be issued if applicable. Final invoices must be paid in full 30 days prior to the first day of your rental. If final payment is not received by the due date, the reservation will be canceled, and the deposit will be forfeited. For future bookings, no deposits will be allowed, and full payment will be required at the time of booking. Late payments may be accepted at the owner's discretion and only if the booking is still available; these payments will be subject to a late fee of 10% of the total booking amount. Credits will be issued for unused time blocks due to weather and/or other related circumstances at the owner’s discretion and approval.

CANCELLATIONS AND RESCHEDULES

If you cancel your reservation, the 50% deposit will be forfeited, and no refunds will be issued. If you cancel your reservation within 30 days of the rental date, you will be responsible for 100% of the total rental cost. Credit will be issued for unused time blocks due to weather and/or other unforeseen circumstances at the owner’s discretion and approval.

WEATHER POLICY

KST will make weather-related decisions at its discretion. If KST cancels a rental due to weather before the reserved time, efforts will be made to reschedule. If rescheduling is not possible, the renter may receive a credit for the unused rental time at the owner's discretion. To prevent damage, KST may close or restrict facility use after severe weather or heavy rain. Renters must stay off the field if there is standing water. For safety, all activities must stop if thunder is heard or lightning is seen. Players, coaches, and spectators should return to their cars and wait 30 minutes from the last thunder sound or lightning sighting before resuming play. Standing under the pavilion during weather delays is not permitted. Play may resume 30 minutes after the last thunder or lightning sighting.

FACILITY CONDITION

The client agrees to inspect the facility upon arrival. If any issues are noted, the client must notify the KST employee on site within the first half hour. If the issue can be fixed immediately (e.g. cleaning, lighting, temperature), we will do our best to address it quickly to allow you to continue with your rental. If the facility is deemed unfit, a partial refund or rescheduling may be offered at the discretion of KST. Please note that the nonrefundable deposit will still apply. If no issues are raised within the first half hour of the rental, the client is considered to have accepted the facility as suitable for their use, and no further claims or requests for refunds will be entertained.

FIELD CONDITIONS AND CLOSURES

For all baseball/softball diamond field rentals, practices may be canceled due to factors such as rainfall, snowfall, and weather forecasts. KST will notify the contact person listed for the rental if there is any standing water on the field. KST reserves the right to cancel or close any field rental due to poor conditions and may reschedule the rental day/time if necessary. If KST closes the fields, credits will be issued for unused time at the owner’s discretion. Renters who do not comply with field closures may face future rental restrictions and removal from the premises.

PARKING AND VEHICLES

Parking is allowed in designated lined parking spots only. No unauthorized vehicles are permitted to be on grass, sidewalks, trails, fields, etc. Parking of vehicles is the responsibility of the renter. Parking of vehicles overnight (including camping) is prohibited.

CLEAN UP/SITE RESTORATION

Normal clean-up shall be performed by the renter. The area should be left in the condition it was received this includes, but not limited to grounds, parking lots used by the renter. All wastepaper and other trash must be thrown away in the appropriate designated trash containers. Damage caused to any part of the facilities or grounds as a result of this rental is the responsibility of the rent. $100 per day penalty will be assessed following rental that KST is not cleaned up by renter, and an hourly rate of $30 per hour for clean up if renter fails to comply with clean up agreement. Other fees: renter is responsible for the actual cost of support services necessitated by the rental group.

SIGNAGE AND ADVERTISING

No signage, banners, tents, equipment, or other apparatus may be located on the facility unless the use and location has received prior approval. All advertising (except that which is incidental to the current rental) and all sale of merchandise or other materials, is forbidden on premises, unless specific approval is obtained prior to rental.

ALCOHOL USE

Alcohol Use is NOT PERMITTED ON PREMISES. NO EXCEPTIONS.

DAYS/HOURS OF USE

Renters must have an application on file in order to use any part of KST with a confirmation email ready to be shown at any time to KST staff. Renters are only authorized to utilize the specific areas requested for renting that were approved in the rental application process.

RELEASE AND INDEMNIFICATION

I hereby make this application for a facility rental through Kendrick Sports Training on the date and hours stated. I also certify that the information on the application is true and that I have read and agree to abide by the facility rental procedures and guidelines that pertain to the use of the facilities. Waiver and Release Information In consideration of being permitted to participate in training and conditioning activities (Training) with Kendrick Sports Training, L.L.C. (KST), the undersigned, on behalf of themselves, the athlete, athlete’s parent(s) or legal guardian(s), assigns, heirs, next of kin and personal representative (Athlete) has read and understands the terms and conditions of this agreement and acknowledges and agrees as follows: 1. The Athlete is in good health, proper physical condition and able to participate in Training. Athlete will disclose any current medical conditions or physical issues that could affect Training. If at anytime the Athlete believes the Athlete, conditions or Facility to be unsafe, Athlete will immediately discontinue Training. 2. The Athlete understands that Training is inherently dangerous and may cause injury or damage, including damage or loss to personal property, serious bodily injury or disability, or death. Athlete assumes all such risk and responsibility for such losses, costs and damages, both known and unknown, arising from any cause or condition, including the sole or gross negligence of KST, its officers, owners, members, agents, employees, independent contractors, volunteers and representatives, and any condition or negligence, including the sole or gross negligence of any training facility (Facility), including its owners, members, agents, employees, independent contractors and representatives. 3. Athlete releases, waives, discharges, covenants not to sue, and will indemnify and hold harmless KST and any Facility, including officers, owners, members, agents, employees, independent contractors, volunteers and representatives, from any and all liability, claims, demands, losses or damages for any and all injuries, disability, death, and/or loss, damage or theft to person or property, arising out of or related to Training, whether arising from the negligence of Athlete, KST, Facility, any other Athletes, or any other individual or entity. 4. Athlete agrees to comply with all directions, instructions and conditions of Training. Failure to comply will result in termination of Training, without refund. Athlete acknowledges that KST has no medical training or education. Athlete gives consent to KST and Facility to seek or perform medical assistance, hospitalization and/or transportation for Athlete to a medical facility for treatment and to be financially responsible for the cost of such transportation, medical assistance or treatment. Athlete acknowledges that KST makes no guaranty of improvement or success of the Athlete as the result of Training. 5. Athlete agrees to pay for all Training session(s) in advance. Athlete must give 24-hour notice of a cancellation. Failure to provide such notice will result in Athlete being charged for such session. In the event KST cancels a Training session, Athlete will not be charged for the session and session may be re-scheduled. Payment is non-refundable. Training sessions are non-transferable. Exceptions may be made for medical concern or documented restriction. All pre-paid Training sessions expire within six (6) months of payment. 6. Athlete authorizes and grants all rights and permission to KST to utilize photos, videos or any other image of Athlete in all forms of printed material, online material including social media, and marketing including but not limited to websites, emails, social media, printed material, etc. 7. The terms and provisions of the Waiver and Release continue in full force and effect following the termination of Training. This Waiver and Release contains the entire agreement between the parties and all prior written and/or verbal agreements. I HAVE READ THIS RELEASE/INDEMNIFICATION, WAIVER AND RELEASE AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY.
